Factors Determining Independent Immigration to Canada

Author: Sourav Sarkar

People are always looking for change for in lifestyle, surroundings, job etc. And in search of this change, we are often attracted towards moving to countries that give us greater opportunities to better our lives, money situation and increase our spending power. Countries like Australia, USA, New Zealand and Canada provide ample opportunities to migrate and own citizenship of that country as well as provide you with opportunities that will give you a better lifestyle.

Canada is such a country that is open to legal immigrants and is a popular destination among those who are looking to migrate to another country from the country that they are born in. Canada is much favourable with its ample land area of 9,900,000 km2 and with a population of almost 96 million residents. The government is stable, the society is democratic and its industrial and agricultural background makes it the seventh advanced nation in the world. This gives a lot of opportunities to individuals who have immigration to Canada on their minds.

The independent Immigrant system is based on the point system, where one can check as well as needs to fulfill the required number of points to legally migrate to the country of Canada. From 2003 the required points have been reduced from 75 to 67. And if you’re a resident of the UK your points reduce by 67 points. The reduction of points was done to attract skilled workers to the country. The category of Independent Immigration System is one of the most popular categories that people opt for when wanting to migrate to Canada. The Government of Canada tried to implement the reduction of points in 2002 itself since, its main intention being that there were already 10,000 immigrant cases that were pending. If a person fulfills atleast 67 points they can definitely establish themselves in Canada.

There are certain factors that are point based;

1. Education has a maximum of 25 points, if a person has obtained a PhD or a Master’s degree or even has 17 years of either a full time or its equivalent and it carries all 25 marks. The least points is 12 and is applicable if one has completed only a one year diploma, apprenticeship or trade certificate in Trade and has a minimum of 12 years or equivalent of it in study.

2. The second factor is ones ability to fulfill the English and French Language ability and has a maximum score of 24 points if you are fluent in both the languages. One can get 16 points if they know the main official language and 8 points if they know the second language.

3. The third factor is the working experience and one can gain a maximum of 21 points. The main qualifications are that one needs to have a minimum of 1 year of full time work experience in 10 years as a manager, skilled occupation or any other well known profession.

4. The Age factor carries 10 points and is applicable if you’re between 21-49.

5. Arranged employment carries 10 points e.g. if one is offered a job by the HRDC (Human Resources Development Canada).

6. Adaptability is 10 points, where your accompanying partner e.g. spouse, in-laws etc fulfills certain levels of education, have been educated in Canada, if they have worked, have extended family or arranged employment in the country.

West Coast Trail - British Columbia, Canada

Author: Scenic Travel Canada

The West Coast Trail is located on the Vancouver Island in British Columbia, Canada. It's the third and southern most part of the pristine Pacific Rim National Park and is considered one of the best multi-day hikes in the world.

West Coast Trail

Stretching for more than 75 kilometers, the West Coast Trail weaves along the rocky and rugged shores from Bamfield, BC to Port Renfrew on the western shores of Vancouver Island. This is a remote location about 2 hours from the capital city of Victoria, BC and is exposed to strong winds and surging tides. Under the protection of Parks Canada, the area is home to some of the oldest trees in the world and is a haven for cougar, black bear and hundreds of species of birds on the Pacific Flyway. Just offshore, migrating Orca and humpback whales feed in the fertile waters.

Thousands of hikers from all over the world come to experience the nearly untouched area and to camp under some of the last remaining ancient forests of the world. To limit the amount of damage to the ecosystem, Parks Canada restricts the amount of trekkers on the West Coast Trail. Permits are required for all hikers (1-800-425-5622 or 1-250-387-1642).

The trail is opened from May 1 to September 30. It's recommended to attempt the hike in September when the summer crowds thin out and the weather is warm and dry.

The West Coast Trail is hard but not too difficult to complete. In sections, people will be pushed to their physical limits as they encounter:

  • towering ladders that take you down deep gorges and up the other side.

  • thick, lush forests with trees wider than cars.

  • deep creeks and trenches that you'll cross on fallen logs with no handrails.

  • endless sandy beaches with the mighty Pacific surf at your footstep.

  • rocky coastal shelves teaming with sea creatures in the intertidal zone.

  • unobstructed gale-force winds that blow ashore during a Pacific storm.

  • mud, oh the mud, deep and thick and unavoidable on the trail.

The West Coast Trail was cut through the wilds more than a century ago to help rescuers reach survivors from the numerous shipwrecks that occurred in the Graveyard of the Pacific. Over 60 ships met their demise off the west coast of Vancouver Island and the fortunate survivors who reached land followed the Lifesaving Trail to safety. Today, it's known as the West Coast Trail.

The West Coast Trail can be hiked in either direction. The northern end is easy for the last 5 kilometers while the south end is twisty, muddy and filled with tree roots and steep sections. Hiking during the off-season is not recommended because of bad trail conditions, heavy storms and a lack of readily available rescue personnel.

The West Coast Trail Information Centre (Pachena Bay) is open daily during the regular season and can be reached at 1-250-728-3234.

Provincial Nominee Programs Allow More Immigrants to Canada

Author: Abhinav

While, every year the Department of Citizenship and Immigration of Canada organizes conferences to discuss on the number immigrants in the country, the PNP, which is the Provincial Nominee Programs are welcoming more overseas immigrants than before. The CIC is planning to grant about 40,000 immigrants under the Provincial Nominee Programs this year.

Jason Kenney, the Minister of Immigration, Citizenship and Multiculturalism of Canada said that they understand that the provinces and territories desire to recognize their own economic immigrants and this is the reason, the Canadian government has decided to increase their projected nominees' admission every year.

He also mentioned that in order to streamline the immigration program of the country, the Immigration Department of Canada is committed to work with their territorial and provincial counterparts.

The Provincial Nominee Programs of Canada gf allow the provinces of the country to nominate people who want to migrate to Canada with the interest of settling down in a particular province. For people, who want to go for Canadian Permanent Residency, Provincial Nomination can be a good option. Every province of Canada has its own PNP. Though, Quebec is not part of the Provincial Nominee Programs but it has own selection process.

As the PNP programs are designed to meet the specific needs of the provinces and territories, therefore requirements for every PNP may differ from each other. On the basis of the needs for workforces, the provinces choose nominees and applicants having the ability for effective contribution to the community.

Candidates, applying via PNP, at first have to get a Provincial Nomination Certificate from the territory or province. When the nomination becomes successful, the candidate has to go for CIC for his or her Permanent Residency Visa.

The applicants who don't qualify for the Federal Skilled Worker plan may qualify for a PNP. Though the Federal Skilled Worker Plan only grants applicants having suitable experience as a skilled worker or a job offer from a Canadian company, several PNP accepted applicants with work experience are considered as semi-skilled workers.

The overseas workers have to get a job offer from an employer of Canada and also have to apply for a Temporary Work visa to qualify for certain PNP. But, before the Temporary Work Visa can be granted, the Canadian employer who wants to employ a temporary overseas worker may have to apply for and get permission of positive Labour Market Opinion (LMO) by the Canadian Human Resources and Skills Development Department. HRSDC will provide an affirmative LMO only when foreign worker will meet all the requirements and the HRSDC will get satisfied that the overseas worker won't be having any negative impact on the labour force of Canada. However, certain work permits can be granted even without obtaining an LMO. For instance: under international agreements, work permits can be obtained without an LMO, like NAFTA (the North American Free Trade Agreement).

In the month of April, this year, the both the Temporary Foreign Worker Program and the criteria for potential Canadian employees and employers have made much tougher. Overseas workers who want to apply for a Temporary Work Visa and the employers of the Canada who want to employ foreign workers are asked to go for an experienced lawyer of immigration to avoid mistakes.

This year, the Federal Skilled Worker Scheme is accepting fewer applications. Therefore, several applicants would have to find some new programs that can provide them the opportunity for the applicants to qualify for Permanent Residency and the Provincial Nominee Programs of Canada.

Canada Celebrates Citizenship Week

Author: anhnguyenmex

"Citizenship Week is an opportunity for Canadians across the country to celebrate their citizenship and to learn more about Canada's history and the pioneers who helped build this great country", so said Citizenship, Immigration and Multiculturalism Minister Jason Kenney.

There are more than 60 special Canadian citizenship ceremonies in communities across the country where many more Canadians will reaffirm their commitment to Canada at community events throughout the week.

Minister Kenney kicked off the week's celebrations by attending a special ceremony at Rideau Hall in Ottawa. The minister and many grade 10 students participated in an interactive game-show quiz that pitted them against two Parliamentary Press Gallery members' knowledge of citizenship and history.

The minister hosted this activity which featured knowledge-testing questions on Canadian citizenship and history. The series of 10 questions were based on Discover Canada: The Rights and Responsibilities of Canadian Citizenship, the study guide for those preparing to meet the knowledge requirement to obtain Canadian citizenship. The questions also featured clips from the Historica-Dominion Institute's renowned Heritage Minute series.

"Discover Canada is an excellent source for both newcomers and established Canadians to find out more about our history and the pioneers that helped to build this great country," said Minister Kenney.

He also said that he was pleased to participate in the challenge during Citizenship Week, and he was very excited to announce the launch of the e-book and mobile application versions of Discover Canada, making the study guide content accessible for users of e-readers, smart phones and tablets.

In addition, Jeremy Diamond, Director at The Historica-Dominion Institute indicated: "We believe that schools have a responsibility to prepare students to be the citizens of tomorrow" and "The Canadian Citizenship Challenge is a fun and interactive way to help strengthen students' understanding of the rights and responsibilities essential to active citizenship".

How to avail Family-Sponsored Immigration Canada

Author: mahesh dwivedi

Canada immigration is mostly desired by foreign nationals to experience a quality living environment. Family-Sponsored Immigration is the common and most popular visa category regarding global immigration or settling to an abroad destination. USA and Canada are among the popular destinations for Family-Sponsored migration practices.

USA and Canada both nations offers open migration policies for global migrants being sponsored by their relatives or loved ones. Family-Sponsored policy entitles visa holders, who are a citizen or have acquired a Permanent Residency in Canada to sponsor their immediate family members or relative to migrate and settle in the concerned country. Canada adopts more lenient visa policies allowing permission to common-law and same-sex partner's eligibility for sponsorship as spouses.

The visa holder interested in sponsoring his immediate family has to present evidences of the financial adequacy so that he can support the essential needs of the dependent or family class migrant. Sponsors have to ensure that their sponsored candidate must not seek any type of financial support from the government. He has to take care of shelter, food, cloth and rest fundamental prerequisites of living. Apart from these, healthcare too should be provided by the sponsor as healthcare of your sponsored migrants will not be covered by public health services provided by Canadian government. The financial requirements are simplified or loosen if the visa holder is sponsoring his/her spouse or a kid whose age is under nineteen years of age and must be unmarried.

Citizens of Federal Canada or Canada PR holders can avail the facility of Family Class Immigration for their immediate family or close relatives. Family Class Immigration is meant for the candidate who is related to the Canadian Sponsor as parent, grandparent, spouse, fiancé, dependent kid, orphaned sister, brother, nephew or grandchild subjected to age criteria. Citing the government leniency over family relation, sponsoring your immediate family migration to Canada is simple and hassle-free.

Immigration involves intricate legal procedures which need to be solved with adequate experience, knowledge and preparation. An expert immigration assistance company or lawyer can assist you with easy family immigration process. The visa assistance agency bolsters your sponsor visa application by their years of experience in handling different cases of such nature. They assist you with case preparation to presentation and till your successful immigration. They root out any legal loophole in you documentation or procedure, driving you to visa approval for desired destination regarding your concerned migrating prospect.

What One Needs to Know About Canada Immigration

Author: abhinav

There is really no dearth of people who are inspired by the concept of immigration to the world destination par excellence, Canada. Such individuals make a move to this lovely ‘Country above the US' for work and other purposes. Many of them eventually get citizenship. Post 1947, law related to domestic immigration has undergone many vital changes, with the most important being the Immigration Act, 1976, aside from Immigration and Refugee Protection Act. The latter is in operation at the present.

Ottawa is famous across the world as a nation with a broad immigration policy, and this is easily discernible via its extraordinary ethnic diversity. At the present, there are as many as 34 ethnic groups in the nation. Recently, Ottawa gave red carpet welcome to 1,140 new immigrants from nearly 104 nations in ceremonies organized all over the nation. While the new immigrants took the oath of the citizenship of Canada, they also bore true loyalty to the Queen of the nation.

Canada Migration as Skilled Workers

Such workers are chosen as permanent residents of the country on the basis of a large number of criteria, amongst others, education, experience related to work, knowledge of English and/or French, and other involved requirements which could turn out to be rather useful to such people for the purpose of becoming financially well settled in the nation in question. Interestingly, the Quebec province of Canada has its distinct set of rules and polices involving skilled immigration and it strictly goes by them.

Talking about Quebec, people keen on migrating to it and interested in staying there, as skilled workers, must gather collect all the information they can lay their hands on for the said purpose. Since the rules and requirements for handing over a completed application could change from time to time, minus prior information, it would be advisable if the involved aspirants keep themselves fully updated and well informed on the subject. This is pretty essential if they are thinking of migrating to Quebec under this class.

While we are on the subject, it would be pertinent to mention that Jason Kenney, Immigration Minister, Canada, the other day, declared that skilled immigrants of the country -- with experience in important professions and those with offers of job from Canada based employers -- will jump the line and be given preference, viz-a-viz others, for immigration to the country.

Immigration Canada With Family Members

Author: Alex

f) Non-accompanying Family Members Declaration (if applicable)

  • Notarized statutory declaration stating your intention to proceed to Canada without your family members (only in case that you do not intend to include your spouse, common-law partner or dependent children in your application)
  • You also need to confirm that you understand that your spouse, common-law partner or dependent children must meet immigration requirements by themselves if they wish to immigrate to Canada.

g) Proof of Settlement Funds

  • Proof of transferable funds in a convertible currency for your settlement in Canada for the principal applicant and family members.

The proof of funds could be:

  • A current bank certification letter
  • Savings balance
  • Fixed or time deposit statements

h) Police Certificates

  • Police certificates of good conduct (Original document) from each country, state or territory in which you and everyone included in the application (18 years of age or over) have lived for six months or longer (since reaching 18 years of age)
  • You should submit your original fingerprints to the authorities conducting the police checks or clearances
  • If the authority in the country where you obtained your certificate will forward the result directly to Citizenship and Immigration Canada, you should attach a note explaining the situation

Please note that:

  • A Police Certificate is required from ALL countries where the applicant and his/her family have resided in for 6 months or more since reaching age 18, along with the country where the applicant currently lives
  • This certificate should be issued by a national or federal police agency if possible. If you do not currently reside in that country, you may need to apply at the local Embassy or High Commission in your country of residence.
  • A Police Certificate (also called certificate of no criminal record), is necessary for every applicant age 18 and older • You should present original Police Certificates and also an original accredited translation if the certificates are not in English or French.
  • The Police Certificate (s) must have been issued in the last six months.

The table in the following pages indicates some of the local Authorities where you could obtain a Police Certificate in several specific countries. Please note that this information may change from time to time; please confirm with local authorities if this information is still valid.

i) Photos

I recommend sending 10 photographs with your application, in case some of them are lost or damaged. You should send photographs of yourself and each member of your family.

I also suggest that you and your family dress well for the photographs (preferably formal or semi formal dress) and do not forget a sincere and warm smile! It will look much better to the visa officer than if you frown.

You should print each applicant’s name and date of birth on the back of each of his / her photographs. Visa officials have very strict requirements regarding photographs, so make sure that you meet all the requirements. These photographs must show a full front view of the person’s head and shoulders. The person’s face should be centered and the photograph should have a white background.

All the photographs should be identical, produced from the same negative, and they should be produced on single weight matte paper.

Education and language ability

a) Education

You should also attach to your application certified/notarized copies of all your diplomas and degrees from all the academic institutions that you have attended. You need to attach certified/notarized copies of the following documents:

  • Post-secondary education documents
  • University (or college) degrees
  • Academic transcripts (original), preferably in university sealed envelopes
  • Other qualifications (notarized professional qualification certificates)

Please note that an academic transcript is an official statement from the University that you attended, detailing your academic record from the period of enrolment. This document normally includes details of the program that you studied since you enrolled in the institution, exemptions granted and also graduation and details of your course status.

b) Language Ability

You have two options to prove your language skills:

1. Take a language test

2. Provide a support written document

I recommend that you choose the first option and take the language test. Even though it will take some time to prepare for the test, present it and receive the results, I believe that it will actually save you a lot of time (since your application could be either refused or delayed if you do not present the test).

1. Take the language test

One of the options that you have to prove your language skills is taking a language test. You can claim points for both official languages (English and French).

One of the advantages of taking the test is that you can be certain of how many points will you receive based on your test results.

You have to take one of the approved language tests in order to claim points for language ability.

Proposed changes in Canada Immigration Rules

Author: Canada Updates

Canada as a place has always been in the priority list of immigrants due to its high standard of living and ample opportunities available there. It has been attracting large groups of immigrants from all over the world. In the recent times many remarked changes have been proposed and implemented in the Canada immigration rules. Citizenship and Immigration Canada (CIC) has introduced changes in the procedures and categories of both temporary and permanent immigration like Temporary Foreign Workers; Federal Skilled Worker and also in Federal and Family Class permanent immigration.

Temporary Foreign Workers

Of late there have been instances of severe exploitation faced by the migrants at their workplace. These occurrences have somewhere made the hopeful immigrants be a bit apprehensive before taking the final plunge of going to Canada. The Canada government to avoid these cases of acting as a deterrent to the inflow of immigrants has proposed certain amendments to the Immigration and Refugee Protections Regulations. These changes have been put forth to protect the interests of those immigrating to Canada under the Temporary Foreign Worker Program. These changes induced by the government are highly necessary for the following reasons :

  • Reduction of exploitation of the workers under the temporary foreign worker program

  • Increment in case of an employer's responsibility towards his foreign employee because if the

  • employer fails to comply with the rules then he will be charged with harsh punishment.

  • Work permits issued under this program is for a temporary phase only

  • Strengthening the government to keep an eye on the temporary foreign workers and their employers.

Changes to the immigration rules

According to the new rules imposed by the government it is now necessary for the employer to prove that his employment offer to the temporary foreign worker is genuine and not fake.

It is necessary for the employer to show that his past record with foreign staff has been well. If a case of manhandling is found in terms of meager wages and inhuman working conditions then the employer will be barred for two years to hire temporary foreign workers.

Full details of the employers, ineligible to employ foreign workers to be given on the Citizenship and Immigration Canada's website.

A four year work limit to be put on the temporary foreign workers followed by another four years where they will not be given the authority to work in Canada.

These changes will be applied in practicality from 1st of April 2011 so as to ensure the fair treatment of

workers in Canada under the Temporary Foreign Worker Program.

Federal skilled worker

The Canada government has initiated certain amendments in the Federal Skilled Worker Program also. Past history shows that changes made in this category has yielded positive results which has acted as a driving force to make the government introduce new ones. These changes have been proposed by Citizenship and Immigration Canada keeping in mind the needs of Canadian society and economy. Some of the changes proposed by CIC under this program are :

  • CIC has proposed to increase the minimum number of points which can be attained by an applicant from 16 to 20 in the language category.

  • Increase in the number of points from 10 to 12 for applicants between age of 25 - 34 keeping in mind factors like adaptability.

  • Reduction in the number of years required of education for doing trade.

  • Reduction in the maximum number of points from 21 to 15 in the area of work experience.

  • Assessment of the job offer given by the employer to avoid potential fraud.

These changes to the Federal Skilled Worker Program have been proposed with the intention of providing better facilities to the immigrants to fulfill their economic goals but as of now have just been limited to theory and not put into practice by the CIC.

ICCRC proposed as the new regulatory body for the Immigration Consultants

Author: Canada Updates

Canada as a place has always featured high in the list of the immigrants. This is something which has stayed with Canada from many years as one of the feathers in its cap to be proud of. To cater to this high inflow of migrants, the Canadian Society of Immigration Consultants (CSIC) was set up by the government in 2003 so as to help those wanting to immigrate to Canada. This was established primarily with the aim of regulating and monitoring the immigration consultants needed by the potential immigrants at the time of immigration. However of late, there have been cases reported of its inefficiency thus resulting in the replacement of the body.

Failure of CSIC

The Canadian government's effort in the light of the setting up of CSIC has turned out to be futile, with it not being able to satisfy the people. With innumerable complaints ranging from high membership fees; unethical practices carried out by the consultants to decisions made by it lacking basic prudence, all the facets of the body has been brought to criticism. Moreover all these complaints being recognized and supported by the Standing Committee has further strengthened the authenticity of these issues thus making the Citizenship and Immigration Canada (CIC) to think in the same light about the Canadian Society of Immigration Consultants.

New regulatory body

On the basis of the analysis carried out by the Standing Committee, regarding the dismal performance of CSIC, Citizenship and Immigration Canada decided to formulate a new regulatory body. This step was taken so as to preserve the integrity and restore the faith of the common people on the immigration system of Canada. In this context a public selection process was started in June 2010 inviting the applications of all those who were inclined to take over the responsibility of the governance of the immigration consultants. Post to a thorough examination of all the submissions and evaluation of the credibility of all the organizations by the selection committee, the report was submitted to the Minister of Citizenship, Immigration and Multiculturalism proposing ICCRC as the one best suited for this purpose.

Strategies proposed by ICCRC

The Immigration Consultants of Canada Regulatory Council (ICCRC) is the body which has been proposed as the replacement to the CSIC as announced by the Citizenship, Immigration and Multiculturalism Minister Jason Kenney on the 18th of March 2011 in Toronto. Keeping all the loopholes of the past in consideration, the ICCRC has promised of an ameliorated immigration consulting industry. Various innovative strategies have been suggested by it such as development of a complaint cell; introduction of public awareness campaigns and even the much talked about ‘helpline ‘for the parliamentary members to enhance factors like accountability, competence and quality consultation.

Benefits of the new body

The promises made by ICCRC in their submission, if are converted into practicality along with a strong management and strict control over the immigration consultants would eventually lead to the fulfillment of the purpose for which it has been chosen. Fake consultants, fraudulent applications and crime groups are the problems which will be uprooted from these measures. Not only will it benefit the government but will bring back the faith of the people on the Canadian immigration system as well as on the government.

Immigration Canada Guide Documents

Author: Alex

In this guide, I will explain to you the application process of the Canadian Permanent Residence Visa under the Skilled WorkerImmigration scheme in three simple steps:

How is this guide organized?

The main objective of this guide is to make your life easier! Decidingto immigrate to another country is a complex decision, and Iunderstand that the last think you expect is to struggle with yourapplication process!

For this reason, this guide has been organized in a very simple way.

The guide is divided in three sections:

1. Meet the Pass - Mark

In this section, I will explain the requirements you must meet in order to be eligible to apply for the Canadian Permanent Residence visa under the Skilled Worker Immigration scheme. These requirements are called the Pass – Mark. Based on your characteristics, such as age, education, work experience and others, you will reach certain points. If you reach the Pass – Mark (a certain number of points) you would be eligible to apply for Permanent Residence Visa under this scheme.

2. Submit your Application

Since September 1st 2006, you must submit a Simplified Application Form before sending your documents to the Visa Office. If you have met the Pass – Mark, you will be able to submit your application! Sometimes you will be required to go to an interview before your visa is approved. The interview is also a very important part of the process, since you will be able to give a great impression to the visa officer.

After submitting your application, your file is received by the Visa Office. Once the Visa Officer responsible for your file is ready to analyze your case, you will be asked for the supporting documents.

3. Gather your supporting Documents

This section is very important! If you have enough points to meet the Pass – Mark, and you have sent your application, you would now be eligible to apply for Permanent Residence under the Skilled Migration scheme! Now you would only have to gather the necessary documents to prove that you have enough points based on your education, work experience, age and other characteristics. This is the more complex part of the application process, since it take time to gather several documents that you have not seen for a while! During this step, many potential immigrants decide to give up and forget about their dream! However, this step makes the whole difference between the immigrants and the people who have great dreams but do not have the courage to achieve them. It is not a difficult step, but it is time consuming. You will have to be patient and very organized during this second step in order to submit a successful application.

When you apply for Permanent Residence visa under the Skilled Worker Immigration scheme, you have two options:

a) Hiring an Immigration Representative:

The first option is to hire the services of an Immigration Representative / Consultant. They are also called Immigration Lawyers. Their job is to make the process easier for you, because they know exactly the documents you need to submit with your application.

They normally charge legal fees and government fees. The legal fees refer to the fees they charge for their consulting services, and the government fees refer to the fees that have to be paid to the Canadian government in order to apply.

According to Citizenship and Immigration Canada (2005), authorized, paid representatives may only be:

  • Immigration consultants who are members in good standing of the Canadian Society of Immigration Consultants.
  • Lawyers who are members in good standing of a Canadian law society and students-at-law under their supervision.

  • Notaries who are members in good standing of the Chambre des notaires du Québec and students-at-law under their supervision.

If you wish to hire an Immigration Representative to assist you with your Permanent Residence application, you need to complete the form called “Use of a Representative” [Number - IMM 5476]. Its purpose is to appoint the representative to establish communication and conduct business with Citizenship and Immigration Canada on your behalf.

This form can also be used to cancel the appointment of the Immigration Representative that you had chosen before.

This Institution (CSIC) was created in 2003, and its main objective is to regulate the activities of Immigration Consultants (its members), who provide immigration services and advice for a certain fee.

Immigration Consultants can be members only if they have demonstrated knowledge and ability to provide immigration advice and represent potential immigrants to Canada. They also have to present and pass a Knowledge and Ethics Test to obtain the membership. The Society has also created a code of conduct called “Rules of Professional Conduct” in order to establish the expected standard of professional conduct and competence for its members. These rules also provide guidance to this profession in order to protect the general public from unprofessional, improper or incompetent service from the members of the Society.

Do You Want To Immigrate To Canada?

I am sure you have heard the phrase, "you snooze, you lose."   Well, that may really be true if you are thinking to immigrate to Canada.

On June 26, 2010, Canadian Minister of Immigration announced important modifications to the Federal Skilled Worker category of Canadian Immigration. The Minister issued instructions to his Department to:

  • Declare a moratorium on new applications under the Federal Immigrant Investor Program
  • Limit the number of Federal Skilled Worker applications, without an accompanying job offer, to 20,000 for the next 12 months.

Moreover, to be eligible as a skilled worker without a Canadian job offer, the principal applicant must have worked for at least one year in the past 10 in one of only 29 listed occupations that are considered "open" for Canadian immigration purposes. To top it off, no more than 1,000 applications will be considered under any one occupation – first come, first served.

Furthermore the immigration issue will be at the center during the Canada's election in 2011.  There are two major immigration points that political parties will be battling for during the election.  The first one deals with the recent proposal that would permit Canadian immigration authorities to detain genuine asylum seeking men, women and children for up to a year. The second controversial issue involves a recently leaked memo indicating that the Canadian and U.S. administrations are on the verge of signing an agreement to put in place a North American security perimeter. In theory, a deal to strengthen continental security while easing the flow of goods and people within the perimeter is a positive objective. However, there is the possibility of Canada giving up sovereignty to the U.S. in a secretly negotiated border security deal.

No one knows about the impact of upcoming election.  It is certain that there are a lot of strong feelings associated with immigration.  However, there is lull for a while.  Earlier this month the result of a survey, which covered 18,000 people in 24 countries, was released.  The question put to these individuals was simple: "If you were presented with the opportunity of moving to Canada, would you?" Overwhelmingly, the respondents answered in the affirmative – including 77 percent of those canvassed in China and 68 percent from India. Seventy-two percent believed that Canada is welcoming to immigrants. Surprisingly, even 30 per cent of Americans would choose Canada if they could.

The good news is that some of the provinces, and especially the province of Quebec, still believe in the human capital model, in which one's total background is given greater importance than their experience in a particular occupation. All it may take is a willingness to learn a little French.

A Canada Immigration (Permanent Resident) Visa is a document which allows a person to live and work anywhere in Canada, and confers upon that person Permanent Resident status. It comes with certain responsibilities and may be revoked if the holder does not meet Canadian residency obligations, or is found guilty of serious criminal activity. A person who is a Canadian Permanent Resident may apply for Canadian Citizenship after 3 years.

A Work Permit allows an eligible visitor to reside and work in Canada for a limited period of time, and restrictions are usually placed on the type of employment which can be pursued. It will not, by itself, lead to Canadian Permanent Resident status. This applies to people who are seeking as skilled worker immigration to Canada.

Immigrating to Canada has over time become more and more complicated. There are currently more than 60 different federal and provincial immigration programs under which an applicant may qualify and it is very difficult for an individual to know which program is most suitable to their circumstances. You can apply a Canadian Immigration Visa Application on your own.  However, your chances of succeeding are increased if a qualified Canadian immigration attorney represents you. Moreover, a perfected application will, in many cases, shorten the immigration process, allowing you to obtain your Canada Immigration Visa faster.

In summary, if you desire to be an immigrant to Canada, you may want to seek immigration lawyer in Canada.
